Perks Terms and Conditions 

1. The Program
  1. Mercury Energy Perks™ is a new customer rewards program brought to you by Mercury Energy in conjunction with Frequent Values™ (a dining and leisure program offered throughout New Zealand and Australia by Entertainment Publications Australia Pty Limited through its popular Entertainment Books™).
  2. Mercury Energy Perks™ offers members discounts and benefits on dining out, activities and attractions, hotels and accommodation and special wine offers.

2. Becoming A Member
  1. Mercury Energy Perks™ membership is available to qualifying Mercury Energy customers for a monthly fee of $1.50, which we will add to your Mercury Energy bills.  The monthly membership fee will continue to be charged to your account until you cancel your membership as described below under “cancellation”.
  2. To qualify to become a Mercury Energy Perks™ member, you must:
    • be the named account holder on a current Mercury Energy customer account (not a prepay account) for a residential property in New Zealand;
    • be at least 18 years of age;
    • complete the membership application process online at the Mercury Energy Perks™ website www.mercuryperks.co.nz or call our Contact Centre at 0800 101810 to register.
  3. Once we accept your membership application, we will send you a welcome pack, including your Mercury Energy Perks™ card, your username and password for the website and your voucher book.   
  4. Your first Mercury Energy Perks™ card will be valid until 1 June 2012. After that date, if you continue to be a Mercury Energy Perks™ member, a new card and voucher book valid for another year will be sent to you.  Simply throw out the old card and voucher book (which cannot be used after it has expired) and start using the new card and voucher book.
  5. Replacement cards will be provided upon request.  A small charge will apply.  Please contact perks@mercury.co.nz  to obtain your replacement card.

3. Membership Benefits
  1. As a Mercury Energy Perks™ member you can:
    1. Enjoy 20% off your total bill, up to a maximum deduction of $25, every time you dine at any participating establishment, just by presenting your Mercury Energy Perks™ card.  See rules of use for further information.
    2. Enjoy great savings on exclusive wines.  Regularly check our website (www.mercuryperks.co.nz) for exclusive wine offers and purchase on-line.
    3. Save up to 50% off the rack rate at hundreds of participating hotels, resorts and motels throughout New Zealand and Australia.  See rules of use for further information.
    4. Use Mercury Energy Perks™ vouchers (either from your voucher book or print them from the Perks website) and enjoy great savings on local activities and attractions, popular take away outlets and more.  See rules of use for further information.  

4. Rules Of Use
  1. Check www.mercuryperks.co.nz to find out who our participating merchants in the Mercury Energy Perks™ program are.  Your Mercury Energy Perks card™ can only be used at participating establishments. 
  2. Mercury Energy Perks™ offers may not be used or combined with other discount programs.  If in doubt, please check with the participating establishment before using your Perks card.
  3. Specific rules apply in relation to the following:
    1. Dining Out
      • Present your Mercury Perks card to your waiter before your bill is totalled to enjoy a 20% saving off your total bill;
      • Only one Mercury Perks card may be used per table/party;
      • The card may be used more than once at the same participating restaurant;
      • All restaurant offers are dine in only, unless otherwise stated.
    2. Wine Offers
      • Purchase fine wines on-line at www.mercuryperks.co.nz using your Mercury Energy Perks™ card and your credit card to enjoy considerable savings. 
    3. Accommodation
      • The 50% discount applies to the participating hotel’s rack rate (the hotel’s maximum published rate that all rates are discounted from), based on single or double occupancy, room only.
      • Participating hotels may offer short-term special rates and if these rates are the same or lower than your 50% discount off the rack rate, you will receive 10% off the best available rate.
      • Participating hotels which do not have a published rack rate will provide 10% off the best available rate.
      • The Mercury Energy Perks™ rate is only available for a limited number of rooms at each participating hotel or until a participating hotel expects to reach a level of occupancy where can they no longer accept any further discounted bookings.  Such determination will be at the sole discretion of the participating hotel.
      • Some hotels may have a minimum night stay requirement during peak seasonal periods.
      • Discounted rates may not apply at selected hotels during peak seasons and special event periods.
      • Hotels may discount only one room per Mercury Energy Perks™ member per night.   Mercury Energy Perks™ cards are non-transferable.
      • The Mercury Energy Perks™ rate does not apply to special packages, seasonal, group or convention rates or travel agency bookings and may not be combined with other discount programs.

        To book your accommodation: 
        1. Login to the Mercury Energy Perks™ website and click on the link to Hotel Accommodation, where you can search, compare rates and book online.
        2. Select the Hotel Accommodation of your choice and make your booking by following the steps detailed online. 
        3. You will receive a booking confirmation number by email. Print and keep a copy of your booking reference.
        4. Present your booking confirmation email and present this with your Mercury Energy Perks™ card upon check in and enjoy your stay.
    4. Use of Vouchers
      Vouchers printed from the website
      • Log on to www.mercuryperks.co.nz to print your voucher.  Vouchers are only valid for four weeks from date of printing.
      • Vouchers must only be printed on a "one Voucher per person per day" basis by pressing the "print voucher" button found next to ‘take away restaurants and attractions’ on the Mercury Energy Perks™ website.
      • Only original printed Vouchers may be used and must not be duplicated.

      Vouchers from the voucher book
      • Vouchers are only valid until the relevant expiry date shown on the voucher. Only original vouchers may be used, photocopies will not be accepted.
      • Present and surrender the voucher from your voucher book at the relevant participating establishment to obtain your discount or benefit. 
      • Carefully read each Voucher before using it.  Vouchers may contain additional terms.
      • Vouchers may not be traded and are not transferable.
      • Vouchers will not be refunded if lost or stolen.

5. Cancelling Your Perks Membership
  1. You may cancel your Mercury Energy Perks™ membership at any time by notifying us on-line and by returning your Mercury Energy Perks™ card and voucher book to:

  2. If you notify us on-line at www.mercuryperks.co.nz that you wish to cancel your membership, we will send you reminders to return your Mercury Energy Perks™ card and voucher book.  However, until we receive your Mercury Energy Perks™ card and voucher book, you will continue to be charged the $1.50 monthly membership fee until either:
    1. we receive your Mercury Energy Perks™ card and voucher book; or
    2. 1 May 2011 (when your Mercury Energy Card expires),
      whichever is earlier.
  3. Once your membership has been cancelled as set out above, we will confirm cancellation of your membership and will stop charging you the membership fee of $1.50 per month. 
  4. If you cease to hold a Mercury Energy residential customer account prior to your Mercury Energy Perks™ membership expiring, your membership will be treated as cancelled and you will be required to return your Mercury Energy Perks™ card and Voucher book to:

  5. If we do not receive your Mercury Energy Perks™ card within 30 days of you ceasing to hold a Mercury Energy residential customer account, as set out at clause 5.4 above, we will charge you a membership fee of $1.50 per month for the remaining months that your current card will be valid for.   This charge will be added to your final bill if your Mercury Energy Perks™ card has not been received within 30 days of you ceasing to hold a Mercury Energy customer account. 

6. Information And Privacy
  1. Any personal information you provide to us when applying for Mercury Energy Perks™ membership (e.g. your name, address, and Mercury Energy customer account details) will be:
    1. held by us in accordance with the provisions of the Privacy Act 1993;
    2. used only for purposes relating to the Mercury Energy Perks™ club (including to process your membership application and to notify you of special offers), supplying you with energy and other associated services, debt recovery and/or credit checking purposes, and for providing you with information about the special offers, discounts and other goods and services that Mercury Energy may from time to time wish to offer you.
    3. The information you provide to us must be correct and complete. If any of the information becomes incorrect or changes, you must let us know as soon as possible.
    4. You have the right to access and request correction of personal information we hold about you. To do so call 0800 20 18 20, and you may advise us at any time by contacting our Customer Service Representatives if you do not wish us to contact you from time to time for marketing purposes.


7. Other Matters

  1. Mercury Energy is a division of Mighty River Power Limited.
  2. Employees of Mighty River Power Limited and its advertising agencies and their immediate families may become members of Mercury Energy Perks™ but are not eligible for entry into any Mercury Energy Perks promotional draws .
  3. Mercury Energy may at any time in its sole discretion, suspend or terminate the Mercury Energy Perks™ program, or any individual Mercury Energy Perks™ membership, or alter or amend the Mercury Energy Perks™ terms and conditions or fees by publishing those alterations or amendments on the Mercury Energy Perks website. In the event that Mercury Energy alters or amends the Mercury Energy Perks™ terms and conditions or fees, your continued membership in the Mercury Energy Perks™ program will indicate your agreement to those alterations or amendments.  If you do not agree with the alterations or amendments, you must cancel your Mercury Energy Perks™ membership in accordance with the cancellation procedure in these terms and conditions.
  4. Mercury Energy Perks™ offers are non-transferable and cannot be redeemed for cash.
  5. Mercury Energy Perks™ offers can only be redeemed at participating establishments.  Check www.mercuryperks.co.nz to find the most updated list of participating Mercury Energy Perks™ merchants.

8. Limitation Of Our Liability
  1. To the fullest extent permitted by law, we do not accept any liability (whether arising under contract, tort, statute or otherwise) to you for any loss, damage, cost or expense you suffer or incur arising from your participation in the Mercury Energy Perks™ program or the supply or use of (or inability to supply or use) a Voucher or discount.
  2. We will use our best efforts to ensure that Participating Merchants honour all discount offers but we cannot be held responsible if any Participating Merchant fails to honour discount offers.
  3. Without limiting the foregoing, we will not be liable to you for any failure or delay:
    • in replacing your Mercury Energy Perks™ membership card; or
    • by a participating establishment  failing to meet the terms on which it agreed to provide a benefit, or otherwise fulfil its obligations, to you.



Grand Prize Pool Competition

The “Grand Prize Pool Competition” refers to the draw to win the Grand Prize of $25,000, through any or all of the five promotions Mercury Energy is running. The opening and closing dates of each promotion are described below.

HOW TO ENTER

  1. Enter the Grand Prize Pool Competition through any of the following promotions:
    1. Movie Club promotion – www.mercurymovieclub.co.nz. The Movie Club promotion starts at 9am on 1 September 2011 and closes at 5pm on 1 July 2012;
    2. Perks promotion – www.mercuryperks.co.nz. The Perks promotion starts at 9am on 1 June 2011 and closes at 5pm on 1 July 2012;
    3. Mercury Three Year Fixed promotion. The Three Year Fixed promotion starts at 9am on 16 June 2011 and closes at 5pm on 1 July 2012;
    4. Mercury Billdozer promotion (previously referred to as “Mercury Cool”). The Mercury Billdozer promotion starts at 9am on 21 September 2011 and closes at 5pm on 1 July 2012;
    5. Mercury Triple Challenge promotion. The Mercury Triple Challenge promotion starts at 9am on 10 August 2011 and closes at 5pm on 1 July 2012.
  2. Each entry must be valid according to the requirements of the particular promotion. Entries received before or after the promotion period will not be accepted.


ENTRY

  1. By entering this Competition, you acknowledge that you have read and accepted the terms and conditions for the Competition.
  2. The Competition is only open to ‘Eligible Entrants’, being individuals who:
    1. have correctly entered the Competition through any of the Mercury Energy promotions listed above and according to the terms for entry into the particular promotion; and
    2. are not employees of Mercury Energy or any of its related corporations or any of their agencies associated with this Competition.


THE DRAW

  1. The “Grand Prize” consists of one prize of $25,000 cash for which there will be one winner.
  2. The Grand Prize draw will take place on 4 July 2012. Entries for each of the promotions closes on 1 July 2012 or as otherwise set out in each of the promotions terms and conditions.
  3. The Grand Prize will be awarded to the Eligible Entrant, by no later than 11 July 2012.
  4. In the event that the winner drawn is no longer a Mercury Energy customer at the date of the prize draw, that winner’s entry will be declared invalid and Mercury Energy reserves the right to randomly draw a new winner from the eligible participants under the same Terms and Conditions.
  5. Mercury Energy’s decision in relation to all aspects of this competition is final and no correspondence will be entered into.


GENERAL

  1. Mercury Energy reserves the right to use the winner’s name, city, town and photo for publicity purposes associated with the Competition.
  2. Mercury Energy reserves the right to modify these Terms and Conditions at any time for any reason. You agree that you will be bound by such changes and that you will not hold Mercury Energy liable for any losses resulting from any such changes.
  3. If you accept the prize, you will be solely responsible for all applicable taxes related to accepting the prize.
  4. To the extent permitted by law, Mercury Energy, suppliers, associated companies and its agencies will not be held liable to you for any direct, indirect or consequential loss or damage whatsoever, including personal injury, which is suffered as a result of, or arising from, your participation in the Competition or winning (or not winning) any prize.


PERKS PROMOTION

  1. The Perks promotion commences on 1 June 2011 and ends on 1 July 2012 (“Perks Promotion Period”). All valid entries submitted during the Perks Promotion Period will automatically go into the draw for the Grand Prize.
  2. There are four ways to enter the Perks Promotion to go into the draw for the Grand Prize:
    • By registering to become a Perks member between 1 October and 30 November 2011.
    • Validating your membership at ‘MyPerks.co.nz’.
    • You may also enter by sending us a receipt showing use of your Perks card or vouchers during the Perks Promotion Period. Fill out the entry form with your details, attach your receipt/s, and return in the supplied Freepost envelope. Receipts must be dated within the Perks Promotion Period.
    • TXT your Perks membership ID (found on your card) and the venue where you used your card to 369. A confirmation SMS will confirm your valid entry. Keep hold of your receipt as proof of your entry. Failure to provide receipts as proof will entitle Mercury Energy to declare your entry invalid and draw a new winner from the list of eligible participants under these terms and conditions. Standard SMS charges apply.
  3. You may enter the Perks promotion as many times as you like during the Perks Promotion Period but you are limited to one entry per day. Each valid entry together with valid receipts, as well as the validation of your membership for the first time, counts as one entry into the Grand Prize Pool Competition. Return your entry in an envelope addressed to Mercury Perks Promotion, Private Bag 92008, Victoria Street West, Auckland 1142.
  4. Late, incomplete, fraudulent, indecipherable or illegible entries, and entries not received will be deemed invalid at our discretion. Mercury Energy may disqualify, from participating in this Competition, any person who tampers with the entry process, or submits an entry not in accordance with these terms and conditions.
  5. By entering the Perks Promotion or accepting the prize, you acknowledge that you have accepted the Grand Prize Pool terms and conditions.


Monthly Prize Draw

Win 1 night for two at the Millennium Hotel Queenstown simply by logging on to www.mercuryperks.co.nz before 29 February 2012.

  1. Log on to www.mercuryperks.co.nz anytime between 1 January and 29 February 2012 and go in the draw to win 1 night for two people at the Millennium Hotel Queenstown.
  2. Only one entry per member per day. Entry is automatic as long as you successfully log on to the Mercury Perks website.
  3. The prize consists of 1 night accommodation in a standard room for 2 people at the Millennium Hotel Queenstown and must be redeemed (used) by 1 June 2012.
  4. The prize does not include transport to, from or while in Queenstown.
  5. The prize is non-transferable and non-redeemable for cash.
  6. The winner will be drawn on 5 March 2012 and notified the next day by phone or email. Only the person who entered the draw can be awarded the winning prize and proof of identity may be required.
  7. In the event that the winner drawn is no longer a Mercury Energy customer at the date of the prize draw, that winner’s entry will be declared invalid and Mercury Energy reserves the right to randomly draw a new winner from the eligible entries.
  8. Mercury Energy’s decision in relation to the prize draw, eligible entries and all other aspects of this competition is final and no correspondence will be entered into.
  9. Employees of Mighty River Power and its advertising agencies and their families are not eligible to enter.
  10. Mercury Energy reserves the right to use the winner’s name, city or town and photo for reasonable publicity purposes associated with the draw.
